Terms of Service

These Terms of Service ("Terms") govern your use of myEASysystem ("the Service"), operated by myEASysystem LLC ("we", "us", "our"), located in Savannah, Georgia.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

myEASysystem is a software-as-a-service (SaaS) platform that provides AI-powered marketing automation tools for home improvement contractors and small businesses, including but not limited to: AI phone agents, automated social media posting, drip campaigns, CRM tools, review management, referral automation, and AI pitch coaching.

2. Account & Eligibility

You must be at least 18 years old and authorized to enter into binding contracts. You are responsible for maintaining the security of your account credentials and for all activity under your account.

3. Subscription & Billing

• The Service is offered on a monthly subscription basis at the rate displayed at the time of purchase.
• All fees are billed in advance through our payment processor (Stripe). You authorize recurring charges to your payment method.
• No long-term contracts. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers on promotional rates ("Gold Founder" pricing) retain their locked rate for the duration of their continuous subscription.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law (including CAN-SPAM, TCPA, and DNC regulations)
• Upload or transmit malicious code, spam, or unauthorized advertising
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Resell, sublicense, or redistribute access to the Service without written consent
• Use automated means to scrape or overload the platform beyond normal use

5. AI-Generated Content

The Service uses artificial intelligence to generate marketing content, phone scripts, social media posts, and other materials. While we strive for quality and accuracy:

• AI-generated content is provided as a starting point and may require human review
• You are responsible for reviewing and approving all content before it is published or sent on your behalf
• We are not liable for any inaccuracies, errors, or unintended consequences of AI-generated content

6. Data & Your Content

• You retain ownership of all data you upload to the Service (leads, customer lists, business information)
• You grant us a limited license to process your data solely for the purpose of providing the Service
• Upon account termination, you may request an export of your data within 30 days

7. Territory Exclusivity

Certain subscription tiers include market exclusivity within a defined geographic territory. Exclusivity is granted on a first-come, first-served basis and applies only during an active, paid subscription. Territory definitions and availability are at our sole discretion.

8. Third-Party Integrations

The Service integrates with third-party platforms (phone system, Google, Facebook, Stripe, etc.). We are not responsible for outages, policy changes, or terms imposed by third-party providers. You agree to comply with the terms of service of any third-party platform accessed through our Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, myEASysystem LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless myEASysystem LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access if you violate these Terms. You may cancel your subscription at any time through your account settings or by contacting us directly.

12. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Georgia. Any disputes shall be resolved in the courts of Chatham County, Georgia.
